Fields of application and modification of the general conditions of sale

The general conditions of sale described below detail the rights and obligations of the company Boros Esthetic and its client in the context of the sale of the following services and goods: Tools and consumables intended for the application of eyelash extensions by professional graduates in this field, make-up products for individuals and services of eyelash extensions and semi-permanent make-up. Any service performed by the Boros Esthetic company implies the buyer's unreserved acceptance of these general conditions of sale.    

 

 

ARTICLE 2

 

Products and services mentioned on the website and customer orders

 

2.1 EYELASH EXTENSIONS

 

Anyone wishing to perform an eyelash extension installation must be over 18 years of age and declare that they have read, understood and approved the content of the information in this declaration, do not suffer from any chronic disease and do not know no other reason for preventing eyelash extensions. From the 29th day a complete application is mandatory.

 

On a natural eyelash are applied as many synthetic eyelashes according to the type of set:

- 1D Classic : Application of 1 brow per eyelash

- 2D Glamor : Application of 2 brows per eyelash

- 3D & 4D Volume: Application of 3 to 4 lashes per lash

- 5D & 6D Volume: Apply 5 to 6 lashes per lash

 

Filling is only possible after a complete application made by BOROS ESTHETIC. The filling is only possible if approximately 30% to 40% of eyelashes remain. 

 

48 hours before application, DO NOT use waterproof mascara, do not lift your eyelashes, do not use make-up, and any oil-based product. For 48 hours after application, it is strongly recommended to avoid any contact of your eyelashes with water and humidity (coffee, tea, soup and other drinks must remain far from your eyelashes, are also to be avoided for 48 hours: washing, oven opening, hairdryer and hot baths, UV and sauna). These precautions are necessary to keep your eyelashes as long as possible. 48 hours after the application, it is recommended to not use mascara, any oil-based product and oily products around the eyes. It is strongly recommended to not pull, rub, scratch the eyelashes. 48 hours later, clean your face and your eyelashes with specific eyelash shampoo and rinse with water.

People suffering from glue allergy, claustrophobia, epilepsy, conjunctivitis and other eye diseases, electro-cosmetic peels and / or having had eyebrow tattoos less than 6 weeks old cannot benefit from an eyelash extension service.

When using botox and / or Hyaluron around the eyes, the application is only possible after 24 hours. When you have an appointment, it is essential to show up without makeup and recommended to arrive on time.

 

Appointments can be made by phone and SMS. It is recommended to book 2-3 weeks in advance if you want a date and time that suits you.

2.2 PERMANENT MAKEUP SERVICES

Anyone wishing to perform permanent make-up must be over 18 years of age and declare that they have read and understood the content of the information in this declaration, do not suffer from any chronic illness and know no other reason for preventing them to the realization of permanent make-up.

Permanent make-up can only be carried out at the client's own request and after having received all the necessary information relating to the method and process of the intervention and once the client has been informed.


In accordance with the general conditions, the consumption of alcohol and medication and / or drugs is prohibited before treatment.

The client acknowledges that:

    - The result of permanent makeup is long-lasting, in general 2 to 4 years, the color gradually fades, its complete disappearance is only possible by laser treatment. It is not possible to determine precisely the number of years concerning the behavior of the micro-pigmentation which in fact varies according to the individual, the age, the type of skin and the external impacts.

    - The intervention can provoke various pain sensations depending on the individual.

    - The measurement of the hold of the pigments and the final shade are strongly influenced by the specific properties of the skin, so predicting and guaranteeing the final result is almost impossible.

 

    -   A change in color may occur as a result of chemical (e.g. skin whitening, fruit acid peeling) or environmental (UV rays in 7-10 days after tattooing) factors as well as due to certain health problems.

  - A part of the pigments introduced is eliminated with the small crusts, lips 50%, eyes and eyelids 30%, on average. This formation usually falls off on its own after 4-6 days. It is FORBIDDEN to scrape or grind the crust formed as a result of pigmentation, it

falls on its own during the healing process.

    - The finalization can take place 30 to 90 days after the realization of the tattoo.

    - Depending on your own sensitivity, permanent makeup can trigger immune responses, some of which are now identified: herpes in case of lip tattoo (common in people showing a predisposition but can also occur in people never suffering from herpes), temperature or fever (rare), allergic skin reaction (very rare).

  - In the event of a predisposition to herpes, the client should inquire with his or her attending physician about the possibilities of pre- and post-operative medical care to which he or she would resort without fail.

  - In order to obtain a rapid and effective treatment and cure, the client declares to have carefully read these conditions and takes note of the content of the information and undertakes to comply with the mentioned instructions.

The client declares that he or she does not wish to have an allergy test and is aware of the possible consequences of this decision.
The client certifies that the shape and color have been selected in accordance with his request.
The client certifies that they are aware of the risks of permanent make-up and submit to the procedure under their own responsibility.

 

 

ARTICLE 3

 

Price

The prices of goods and services sold are those in effect on the day the order is taken. They are denominated in Swiss francs (CHF) excluding VAT and not subject to VAT. Consequently, they will be increased by the transport costs applicable on the day of the order.

Boros Esthetic reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

 

 

ARTICLE 4

 

Booking and Payment Terms

 

Reservations are effective only when the payment of the deposit has been received by the company Boros Esthetic, a deposit of 50% of the total amount. The balance must be paid no later than the day of the service. Any change of appointment is made at least 24 hours in advance and can be made only once, beyond, any other change will be considered as a cancellation and the 50% deposit will be considered due and collected by the company Boros Esthetic. In case of cancellation of reservation, the 50% deposit will be considered due and collected by the company Boros Esthetic. Payments for products and services can be made by credit card, bank transfer, TWINT or cash. 

 

 

 

ARTICLE 5

 

Deliveries & shipments

The delivery of the goods is carried out either by delivery directly to the institute or to the place indicated by the buyer on the order form. Unless otherwise stated, we provide a 48 hour dispatch time in Switzerland only. Our deadlines apply only for products in stock at the time of validation of the order.

Consequently, any reasonable delay in the delivery of the products will not be able to give rise to the profit of the purchaser to an allowance of damages or to the cancellation of the order. The risk of transport is supported by the company Boros Esthetic.

In the event of missing or damaged goods during transport, the buyer must formulate all the necessary reservations on the order form upon receipt of said goods. These reservations must also be confirmed in writing within five days of delivery, by registered post. The buyer is responsible for transport fees.

ARTICLE 7

 

Data protection

 

Boros Esthetic Institute transmits personal data to third parties only insofar as they are essential for the proper execution of the Order.

Boros Esthetic Institute reserves the right to analyze all data collected and to use information on purchasing behavior in an anonymous form for commercial purposes.

The Boros Esthetic Institute is entitled to delete a registered Client from its computer files at any time, that is to say terminate his registration, with immediate effect, without having to justify his decision, without notifying the Client and without that the registered customer in question cannot formulate any claim vis-à-vis the company. This particularly applies to registered customers who violate these general conditions.

Excluded registered customers are not allowed to re-register as registered customers on the Institut Boros Esthetic website, either under their own name or under another name, without the prior consent of L'Institut Boros. Esthetic.

 

ARTICLE 8

 

Force majeure

The responsibility of the company Boros Esthetic cannot be questioned if the non-performance or the delay in the performance of one of its obligations described in these general conditions of sale results from a case of force majeure. . As such, force majeure means any event that is both unforeseen and insurmountable, resulting from external conditions and beyond the control of a person.

 

 

ARTICLE 9

 

Court of competent jurisdiction

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to Swiss law.

In the absence of an amicable resolution, the dispute will be brought before the Lausanne Commercial Court (CH 1014).
